Jacquelyn Tran launched her website in 1999, she never anticipated how much her choice of url (domain name) would cost her. To date the Huntington Beach based company has spent 100 of thousands of dollars against Ebay in there legal war. Perfumebay against ebay, the sad part is ebay makes 4 billion apposed to this small town business. Butdispite the size this company is not giving up fighting ebay with whatever they can. Ebay has a trademark which has put other companies out of business like autobay and rentbay. The 3 judge panel all agreed that perfumebay needs to be changed. Tran says she will appeal and asked for a emergency stay of the injunction to keep running her site. A typical trademark case cost about 1 million dollars. Tran recommends checking with us patents before choosing a name to save the time and money she has had to invest in this losing battle. Registering the domain name doesn’t mean your safe even with one letter off from a trade marked name can cause URL’s to collide.

We have all heard the forecast and now know that blogging is hear to stay and only getting bigger. Despite it’s cheesy name it is a very serious business tool. Businesses must conform to new marketing techniques to accommodate new media. Businesses will get left behind quickly if not staying current with the quickly evolving media market. Some business have already made changes to fit the new standard in the technological generation. People are soon starting to trust blogs more then the national news media.
Does this mean to throw out former marketing methods and join the masses? Social networking is part of marketing but you must communicate to your consumer no matter what means possible.
As major companies like Disney hire bloggers to spread the word about events, as said by the Vice President Mrs, Wiley says. “Focus on the consumer” ” Reach them where they are”

John Anton’s problems began with a phone call. It was a customer looking for a website like his. He thought it was strange and asked where the person heard of this. He was then told there is clones of his website for sale. John spent about 300k to develop his drag and drop logo clothing company. But now you can get the same site for about $1000 just like his! Frustrated he started research And found lots of websites just like his even with his images. Lawyers best advise was to try to sue the company but they where located in India where laws are obviously much different. The good news was John could go after any sites using this code in the US. After 12k in legal fees he got several sites shutdown in the US using the code and about $3500 in settlement fees. Still upset and baffled he atleast stood his ground and feels good about not taking such a attack for granted.
The next step was to hire a security company and make sure the new code is secure and protected.
